Terms of Service

These Terms of Service ("Terms") govern your use of the AxleWise mobile application, website, and related services (collectively, the "Service") provided by AxleWise.ai LLC ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and legally able to enter into binding contracts to use the Service. AxleWise is designed for commercial drivers, fleet operators, and transportation professionals. You are responsible for maintaining the accuracy of your account information.

2. Your Account

• You are responsible for keeping your password and account credentials secure.
• You agree not to share your account with others or allow unauthorized access.
• You must notify us promptly at support@axlewise.ai if you believe your account has been compromised.
• One account per user. Shared or enterprise accounts are not supported at this time.

3. Acceptable Use

• You agree to use AxleWise only for lawful load planning and transportation purposes.
• You will not reverse-engineer, decompile, or attempt to extract the vehicle database or calculation engine.
• You will not use the Service to plan or facilitate any illegal overweight or over-dimensional movement.
• You will not abuse, overload, or attempt to disrupt the Service or its infrastructure.
• You will not scrape, crawl, or automatedly access the Service beyond normal app usage.

4. Subscriptions and Billing

• AxleWise offers a free trial period, after which a paid subscription is required to access premium features.
• Subscriptions are billed through Apple's App Store or Google Play, depending on your device.
• Subscriptions renew automatically unless cancelled at least 24 hours before the renewal date.
• You can manage or cancel your subscription at any time through your device's store account settings.
• Refunds are handled by Apple or Google according to their respective refund policies — we do not issue refunds directly.
• We may change subscription pricing with reasonable advance notice. Existing subscribers will be charged the current rate until their subscription renews.

5. The Tool, Not the Truth

AxleWise is a planning and estimation tool. Axle weight calculations, height clearances, and load distributions generated by the Service are estimates based on manufacturer specifications and mathematical models. They are not a substitute for:

• Certified weigh station readings.
• State or federal DOT compliance verification.
• Professional judgment of a qualified driver or fleet manager.
• Actual measurement of any specific vehicle's weight or dimensions.

Vehicle weights and dimensions vary based on configuration, fuel load, cargo placement, and modifications. Always verify actual axle weights at a certified scale before departure.

6. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that:

• The Service will be error-free, uninterrupted, or available at all times.
• Weight calculations, height estimates, or vehicle data will be perfectly accurate.
• The Service will prevent overweight citations, fines, or DOT violations.
• Your device, operating system, or carrier will support all features.

You use AxleWise at your own risk. Professional judgment and certified scales are the final authority.

7. Limitation of Liability

To the maximum extent permitted by law, AxleWise.ai LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to:

• Overweight citations, fines, or penalties.
• Vehicle damage, cargo damage, or accidents.
• Lost revenue, lost profits, or business interruption.
• Compliance failures or regulatory actions.

Your total aggregate liability for claims related to the Service is limited to the amount you have paid us in the 12 months preceding the claim, or $50 USD, whichever is greater.

8. Intellectual Property

All content in the Service — including the AxleWise name, logo, vehicle database, calculation engine, user interface, and documentation — is the property of AxleWise.ai LLC and is protected by U.S. and international intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service without our written permission.

9. User Content

You retain ownership of any vehicle data, load configurations, and custom entries you create in the Service ("User Content"). You grant us a non-exclusive, royalty-free license to store, process, and display your User Content solely as needed to operate the Service for you. We do not sell or share your User Content with third parties.

10. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any conduct we believe harmful to the Service or other users. You may delete your account at any time by emailing support@axlewise.ai. Upon termination, your right to use the Service ends immediately.

11. Governing Law

These Terms are governed by the laws of the United States and the state in which AxleWise.ai LLC is registered, without regard to conflict of law principles. Any disputes shall be resolved in the courts of that jurisdiction, unless you are a consumer in the EU or UK, in which case you may bring proceedings in your local courts and mandatory consumer protections apply.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you in-app or by email and update the "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
